EvolutionEmail Terms Of Service
By signing up and actively using the EvolutionEmail program you agree to all terms
and conditions set forth in this agreement. EvolutionEmail may, at any time, choose
to edit, add and/or delete portions of this agreement and impose changes without prior
notification of its members. Members will be informed of any and all changes to this policy
via an email to their primary contact email address provided upon signing up with EvolutionEmail.
If any modification is unacceptable to you, your only recourse is to terminate this agreement by cancelling your account with EvolutionEmail.
Your continued participation in the EvolutionEmail program following our posting of a change
in policy notice or new agreement on our site will constitute binding acceptance to the change.
About Our Site:
EvolutionEmail.Com Is A Pay For Action Website! Our Company Is NOT A Multi-Level Marketing Program, Get
Rich Quick Scheme, Or Matrix Website. We Do Not Require Our Members To Sell, Invest, Buy, Or To Recruit
New Members In Order To Be Paid. We DO NOT Sell A Product!! Members Are Independent Contractors Who
Are Paid To Read, Visit Websites And Consider What The Advertiser Offers. We Do Require That Members Be
Active And Show An "Honest" Interest In The Advertisements They Receive. We DO NOT Tolerate Cheaters,
Inactive Members, Or Cheat Bot Users! Such Members Are Deleted From Our Site On A Daily Basis.
Responsibility of Members:
You must be 18 years of age or older. Minors must have parental consent to participate in this program.
Our program is open to both US and International members, and is void where prohibited by local governing
laws. Any account found in violation of this will be deleted immediately. You may not signup
multiple times with different email addresses.
Sharing of a Computer:
Your computer must not be shared with another individual that
has an existing EvolutionEmail.com account. Only one (1) account per household is allowed.
Account Security:
You are solely responsible for any and all use of your
EvolutionEmail account including authorization by you to any third party individual who may use your account.
You will use your
email address / password combination to access your account, it is your responsibility to keep this information
confidential.
Changing Your Personal Information:
You may change this information by logging into your EvolutionEmail account and pressing the
user account information link. Any solicitation of advertisers for a confirmation email for purposes of receiving credit
in your account will be grounds for immediate termination.
Selling of Your Account:
You may not sell,trade or transfer
any part of your EvolutionEmail acct or parts thereof including ads. Any
attempt to do so will be grounds for immediate termination of your account.
Inactive Members:
In the event you do not click a link in 30 days your account will be deleted for inactivity and you will loose all earnings and referrals. Please keep your account active as your account will not be fixed if it is deleted.
Vacation:
Anyone who sets their account to vacation and doesn't return within 30 days must email the webmaster to ask for permission to extend their inactivity.
Fraud:
Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by
EvolutionEmail be detected it may result in member termination and possible legal action.
Abuse of Administration:
Abuse of members of management; Be it owner, manager, or someone assisting onsite, will be grounds for immediate termination of your account.
Examples are:
Sending harrassing or other wise insulting , or threatening emails;
Using forums, or websites , or emails to publicly slander or abuse a member of staff.
We will NOT treat you with disrespect, and we WILL NOT accept less from our members!
Maintaining Your Email Account:
You must maintain your
email account that you used when signing up EvolutionEmail. You agree to receive email advertising from
EvolutionEmail.
Your Account Information:
Any accounts with bogus, false, abbreviated or incomplete information will be terminated and all earnings will be forfeited. If your IP address and country do not match, your account will be terminated and all earnings will be forfeited.
Bounced Mail:
In the event your email account on file becomes closed or blocked for 7 (seven) or more days to
messages from EvolutionEmail your account will be terminated and you will forfeit all prior earnings. In the event
your email account on file is full for 7 (seven) consecutive days your account will be terminated and you will forfeit
all prior earnings.
Auto-Responders::
Auto-Responders will be considered bounced mails! If we receive these for 7 consecutive days your account could be terminated! If terminated, you lose all monies and referrals.
Searching:
Only certain countries are allowed to search. The decision on who is allowed to search is made by the search engines. The countries allowed are: United States, Canada, Australia, Austria, Belgium, Denmark, Finland, France, Germany, Greece, Iceland, Italy,Malta Netherlands, New Zealand, Norway, Portugal, Spain, Sweden, Switzerland, and United Kingdom. If anyone is caught checking off "Search" as one of their interests, and you are not allowed to search, or searching your account will be terminated, all funds forfeited, and downline canceled. If you are from a country not listed, and you search, you run the risk of getting the advertiser's affiliate account closed, and they lose all their earnings.
Redemptions:
You may choose to use your earnings for advertising at any time. You may do this by visiting the redemption page listed in your earnings account area. When sending in banner codes please make sure that your banner is working properly. if it says yourwebsite.com then please upload the banner to your website and fill in the proper information for the banner image to show. This will help speed up the process in getting your banner placed and your advertising going much quicker.
Family Friendly Site:
Our Site is a family friendly site. We WILL NOT allow any Illegal or Adult websites to be advertised on our Paid To Read Site. We will also not except any ads, banner impressions, paid to clicks, or page links for sites that promote any kind of Hate, Sites that promote violence of any kind, Sites that promote Hacking, questionable or illegal activity. Anyone sending in an ad for any of the above sites will have their accounts terminated without notice and will not be credited for any earnings or referrals.
Cheat Links and Banners:
You understand that there will be a banner placed in the paid to click sections and also in email ads clearly marked D.O. N.O.T. C.L.I.C.K If you click these links or banners your account may be terminated without notice to you. If this happens your account will not be restored and you will loose all earnings and referrals. The usage of any email reading software is strictly prohibited. .
Earnings:
Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by Email Evolution.com. Members may earn by referring new members to the Email Evolution.com program. You must be at least 50% as active as your downline in order to receive earnings from your referrals. Meaning if your downline is clicking every paid link, you must click at least 50% of the paid links sent out.
Referral Earnings:
Members will earn 55% of their direct referrals earnings.
Downline Credit:
You must be at least 50 Percent as active as your downline in order to receive credit for your downline earnings.
Link Errors:
At times we may send out a link that was for the wrong amount. You understand that if this happens we reserve the right to do a roll back on your account and deduct mistaken earnings from your account.
Paid To Sign Up:
Members will be paid from 5 cents to 50 cents for each valid sign up performed through our Paid to Sign Up Section. You must include the welcome email for the site you signed up for in the area provided (be sure to remove your password from this email). Members who enter anything else besides the welcome email will not receive credit and their accounts will be charged 5 cents for each invalid entry they submit. Members also understand they must remain an active member of the program signed up for for 30 days or will lose signup monies paid.
Attachments:
Support, redemptions, payout requests and any form of
communication sent as an attachment will be deleted. You will not be
contacted for a replacement. You will forfeit the redemption and have to
request any payout again. There may also be a fine of 50 cents per incident.
Repeat violators may have their accounts terminated and all earnings lost.
Violation of Terms Fines:
Anyone who Violates the Terms will receive a 50 cent Violation of Terms (VOT) Fine. Reasons for receiving a VOT include
requesting payout with no payment information listed on account. Or have incorrect payment information listed, IE listed
Stormpay, but have numbers instead of Email Address. Anyone caught with search box marked off in the interest category who
are not from these countries: Australia, Austria, Belgium, Canada, Denmark, Finland, France, Germany, Greece, Iceland, Italy,
Malta, Netherlands, New Zealand, Norway, Portugal, Spain, Sweden, Switzerland, United Kingdom & United States. Have incomplete
address filled in. Have E-gold As a payment option, WE DO NOT PAY THROUGH E-GOLD. All these VOT's listed above are 50 cent
violations. Since it is possible to receive more than 1 violation, if you reach -$1.50 your account will be deleted. Cheat link's
are a deducted violation of $1.00. Incorrect english test answers are also $1.00 fines. None of these fines will be refunded, they
are final.
Relationship of the Parties:
You and EvolutionEmail are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency,
franchise, sales representative or employment relationship between you and Evolutionemail. You understand that you do not have
authority to make or accept any offers or make any representations on behalf of EvolutionEmail. You may not make any statement,
whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting
and payment of any taxes for money earned while using the program.
Limitation of Liability:
EvolutionEmail will not be liable for lost profits, lost business opportunities, or any other indirect, special,
punitive, incidental or consequential damages arising out of or related to this Agreement or EvolutionEmail program,
even if EvolutionEmail has been advised of the possibility of such damages. Furthermore, EvolutionEmail aggregate
liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this
Agreement. The provisions of this Section survive termination or expiration of the Agreement.
Payments:
Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the
area on the website provided by EvolutionEmail. Members may earn by referring new members to the EvolutionEmail program. Members
will earn a percentage of advertising revenues collected by EvolutionEmail. Members will be paid via PayPal or Check. EvolutionEmail
will pay members when their balance reaches the minimum payout rate of $3.00 USD($1.50 must be in personal earnings to cashout) set by EvolutionEmail.
Once the member has reached payout they may request payment.In order to
receive comission on referral earnings the member must be at least 50% as active as their downlines. Payments will be made by the 10th of the following month. Or within a reasonable time after. Members from China and India must have a VERIFIED paypal account in order to cashout! Members from China and India will be paid by check only after sending proof od ID to the webmaster. members from China and India may also be contacted by email and or messenger to verify that they are English speeking members.
Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of
mass communication (downline builders are acceptable). Failure to comply will result in immediate termination of your membership with EvolutionEmail and may result
in legal prosecution. EvolutionEmail strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming
will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable
for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. EvolutionEmail
may charge up to $5 per spam email sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts.
Signing up multiple times from the same computer also constitutes fraud. EvolutionEmail will file charges for recovery of any earnings
received from multiple sign-ups.
